Extenze sued for second time in 2010; this time by Robby Gordon

Earlier in the season, Extenze and Kevin Conway were sued by Front Row Motorsports after the team claimed that Biotab Nutraceuticals, the parent company of Extenze, hadn't fulfulled their end of the contract.

Now, Robby Gordon is suing Extenze, saying that the company originally agreed to let him drive the car when it became close to falling out of the top 35 in owner's points but didn't pay him for those races.

But when Kevin was in danger of falling out of the prestigious top 35 ranked cars -- Robby asked the Extenze people if he could personally drive the Extenze car instead.

In his lawsuit, filed today in L.A. County Superior Court, Gordon claims the Extenze people initially agreed to the deal ... so he made the switch.

It was only after the races, Gordon claims, that Extenze refused to pay him citing breach of contract because he got in the driver's seat instead of Kevin.

Gordon's asking for $690,000 in damages.

Conway went to Gordon's team after leaving Front Row in August (before the team's lawsuit. Conway then said in October that he hadn't been paid in full by Front Row). The top-35 rule was also in the middle of Front Row's lawsuit, as Conway's contract stipulated that he had to be driving a car that was guaranteed into the field.
